1. Acceptance of Terms

Welcome to HausControl LLC ("HausControl," "we," "our," or "us"). By accessing or using our website at hauscontrol.io (the "Site") or engaging our services, you ("you," "your," or "Client") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Site or services.

2. Description of Services

HausControl provides smart home consulting, configuration, automation design, and related services ("Services"), including but not limited to:

  • Smart home consultation and assessment
  • Device selection and compatibility recommendations
  • Smart home system configuration and setup
  • Automation creation and optimization
  • Troubleshooting and technical support
  • Follow-up support as agreed upon

Services are provided on a project-by-project basis or as otherwise agreed in writing.

3. Eligibility

You must be at least 18 years of age to use our Services. By using the Site or Services, you represent and warrant that you meet this requirement.

4. Consultation and Service Agreement

4.1 Initial Consultation

We typically begin with an initial consultation to assess your needs. This consultation may be free or paid, as specified at the time of booking.

4.2 Service Proposals

Following consultation, we may provide a written proposal outlining:

  • Scope of work
  • Timeline and milestones
  • Pricing and payment terms
  • Any limitations or exclusions

4.3 Acceptance

Services begin only after you accept our proposal and any required deposits or payments are received.

5. Pricing and Payment

5.1 Fees

Service fees are outlined in your written proposal or service agreement. Pricing may include:

  • Consultation fees
  • Configuration and setup fees
  • Hourly or project-based rates
  • Device or equipment costs (if purchased through us)
  • Travel fees (if applicable)

5.2 Payment Terms

Unless otherwise agreed:

  • Payment is due as specified in your service agreement
  • We may require a deposit (typically 50%) before beginning work
  • Final payment is due upon project completion or as agreed
  • Accepted payment methods will be specified in your agreement

5.3 Late Payments

Late payments may be subject to additional fees or interest as permitted by law. Continued service may be suspended until payment is received.

5.4 Expenses

Any approved out-of-pocket expenses (parking, tolls, specialty equipment) will be billed separately or included in the total fee as agreed.

6. Cancellation and Rescheduling

6.1 Client Cancellation

You may cancel or reschedule a scheduled appointment with at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.

6.2 Our Cancellation

We reserve the right to cancel or reschedule appointments due to emergencies, illness, or unforeseen circumstances. We will provide as much notice as possible and work with you to reschedule.

6.3 Refunds

Deposits are generally non-refundable once work has begun. Refunds for services not yet performed will be considered on a case-by-case basis.

7. Client Responsibilities

To ensure successful service delivery, you agree to:

  • Provide accurate information about your smart home setup and needs
  • Grant necessary access to your home and devices during scheduled appointments
  • Ensure Wi-Fi and internet connectivity are available during service
  • Have account credentials ready for devices and services we will configure
  • Inform us of any safety concerns or property access limitations
  • Review and test configured systems while we are present when possible

8. Device Access and Credentials

8.1 Access

You grant us temporary access to your smart home devices, accounts, and systems solely for the purpose of providing Services. This access will be revoked immediately upon completion of services unless ongoing support is agreed upon.

8.2 Credential Security

We do not store your passwords or login credentials after service completion. You are responsible for changing any temporary credentials or access codes provided during service.

8.3 Privacy

We respect your privacy. We will not access, monitor, or record data from your devices (cameras, sensors, etc.) beyond what is necessary to provide the agreed-upon Services.

9. Warranties and Disclaimers

9.1 Service Warranty

We will perform Services in a professional and workmanlike manner consistent with industry standards. We warrant that Services will substantially conform to the agreed-upon scope of work.

9.2 Third-Party Products

Smart home devices, software, and platforms are provided by third-party manufacturers. We do not manufacture these products and cannot guarantee their performance, compatibility, or longevity.

Any warranties on devices or products are provided by the manufacturer, not by HausControl.

9.3 No Guarantee of Results

While we strive for optimal performance, we cannot guarantee that all smart home devices or automations will work perfectly in all situations due to:

  • Internet or Wi-Fi connectivity issues
  • Manufacturer software updates or changes
  • Device compatibility limitations
  • Changes to third-party platforms or services

9.4 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

10.1 General Limitation

TO THE FULLEST EXTENT PERMITTED BY LAW, HAUSCONTROL'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO HAUSCONTROL FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

10.2 Exclusion of Damages

IN NO EVENT SHALL HAUSCONTROL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data or information
  • Property damage (except as provided in Section 10.3)
  • Personal injury (except as caused by our gross negligence or willful misconduct)
  • Damage to devices or systems not directly caused by our actions

10.3 Property Damage

We will use reasonable care when working in your home. If we directly cause damage to your property through our negligence, our liability is limited to the lesser of: (a) the cost to repair or replace the damaged property, or (b) $1,000 per incident.

We are not responsible for:

  • Pre-existing damage or defects
  • Damage caused by third-party devices or software
  • Damage resulting from your failure to follow our recommendations
  • Normal wear and tear

10.4 Insurance

We maintain general liability insurance. Claims for property damage should be reported to us immediately in writing.

11. Indemnification

You agree to indemnify, defend, and hold harmless HausControl and its owners, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your breach of these Terms
  • Your misuse of our Services
  • Your violation of any law or third-party rights
  • Any inaccurate or incomplete information you provide

12. Intellectual Property

12.1 Our Property

All content on our Site, including text, graphics, logos, designs, and software, is the property of HausControl or its licensors and is protected by intellectual property laws.

12.2 Custom Configurations

Upon full payment, you own the custom automation routines and configurations we create specifically for you. However, we retain the right to reuse general methodologies, techniques, and non-client-specific knowledge in our work with other clients.

12.3 Client Materials

You retain ownership of any materials, data, or information you provide to us.

13. Confidentiality

We will keep confidential any sensitive information we learn about you, your home, or your smart home setup. We will not share this information with third parties except:

  • As necessary to provide Services (e.g., contacting device manufacturers for support)
  • As required by law
  • With your explicit consent

14. Termination

14.1 By You

You may terminate an ongoing service agreement with written notice. You will be responsible for payment for any work completed up to the termination date.

14.2 By Us

We may terminate or suspend Services if:

  • You breach these Terms
  • You fail to make required payments
  • Continuing the relationship is no longer feasible

14.3 Effect of Termination

Upon termination, you must pay all outstanding fees for Services rendered. We will provide you with any documentation or information related to completed work.

15. Dispute Resolution

15.1 Informal Resolution

If you have a concern or dispute, please contact us first at info@hauscontrol.io so we can attempt to resolve it informally.

15.2 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

15.3 Venue

Any legal action arising from these Terms or the Services must be brought in the state or federal courts located in Queens County, New York. You consent to the personal jurisdiction of these courts.

15.4 Arbitration (Optional)

For disputes involving amounts under $10,000, both parties may agree to binding arbitration as an alternative to litigation.

16. General Provisions

16.1 Entire Agreement

These Terms, together with any signed service agreement or proposal, constitute the entire agreement between you and HausControl regarding the Services.

16.2 Amendments

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site or Services after changes constitutes acceptance.

16.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

16.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

16.5 Assignment

You may not assign or transfer these Terms or any rights under them without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

16.6 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and HausControl.

16.7 Force Majeure

We are not liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, government actions, or utility failures.
